Terms & Conditions - the basics

1. ASSUMPTION OF RISK

I understand that participation in a fishing charter involves inherent risks, including but not limited to:

  • Slips, trips, and falls on a moving vessel

  • Hooks, knives, gaffs, fishing gear, and marine life

  • Weather conditions, waves, wind, and boat motion

  • Seasickness, dehydration, sun exposure, or allergic reactions

I voluntarily choose to participate and assume all risks, whether known or unknown, associated with this activity.

2. RELEASE OF LIABILITY

In consideration of being allowed to participate, I hereby release, waive, and discharge Dying Breed Charters LLC, the vessel owner, captain, crew, and affiliates from any and all claims for personal injury, illness, death, or property damage arising out of ordinary negligence during the charter.

This release does not apply to gross negligence or willful misconduct, as prohibited by New Jersey law.

3. AGREEMENT TO FOLLOW CAPTAIN’S INSTRUCTIONS

I agree to follow all instructions given by the captain or crew. Failure to comply may result in termination of the trip without refund for safety reasons.

4. MEDICAL CONSENT & FITNESS TO PARTICIPATE

I certify that I am physically able to participate in a fishing charter. In the event of an emergency, I authorize the captain/crew to obtain medical treatment on my behalf and agree to be responsible for any associated costs.

5. MINORS

Minors are permitted aboard the vessel only with a parent or legal guardian present.

The undersigned adult accepts full responsibility for the supervision, conduct, and safety of all minors in their party and agrees to the terms of this waiver on their behalf.

All minors must comply with New Jersey coastal and maritime laws regarding life jackets, including required wear based on age, vessel type, and conditions. Parents or guardians are responsible for ensuring compliance at all times.

6. ALCOHOL & DRUG POLICY

  • Cans only are permitted aboard the vessel

  • No hard alcohol

  • No glass containers

  • Illegal drugs are strictly prohibited

  • Intoxicated or unsafe behavior will result in immediate termination of the trip without refund

7. DEPOSIT, CANCELLATION & NO-SHOW POLICY

  • A $200 non-refundable deposit per boat is required to secure the charter date

  • Deposits are applied toward the total charter price

  • Deposits can be applied to another trip or refunded only if the trip is cancelled by the captain and another date cannot be determined

  • Weather-related cancellations are at the captain’s discretion and may be rescheduled

  • No-shows or late arrivals forfeit the deposit

8. PAYMENT TERMS

  • Total charter price: $700 per boat (includes the $200 deposit)

  • Remaining balance: Due upon arrival on the day of the charter

  • Accepted payment methods: Cash, check, or Venmo

  • Gratuity is not included and is appreciated

  • Maximum of 4 passengers total — no exceptions

9. WEATHER & FISHING CONDITIONS

I understand that:

  • Weather and sea conditions may change

  • The captain has final authority to delay, shorten, or cancel a trip for safety

  • Fish are not guaranteed

10. PERSONAL PROPERTY

Dying Breed Charters LLC is not responsible for loss or damage to personal belongings, including phones, cameras, clothing, or gear brought aboard.

11. PHOTO & VIDEO RELEASE

I grant permission for Dying Breed Charters LLC to use photos or videos taken during the charter for promotional, marketing, or social media purposes without compensation.

12. GOVERNING LAW

This agreement shall be governed by and interpreted under the laws of the State of New Jersey.
